As part of the Craft Beverage Modernization and Tax Reform Act of 2017 (CBMA), effective January 1st, 2018 the Internal Revenue Code was amended with respect to the excise tax treatment of certain alcoholic beverages including liquor, beer and wine imports. Under CBMA, reduced tax rates and/or tax credits are applicable to importations of certain limited quantities of distilled spirits, beer or wine imported from each foreign producer/assigning entity.
 
In order for U.S. Customs and Border Protection (CBP) to be authorized to issue refunds owed on entries, the regulations were changed to reflect this authorization in the interim final rule on Refund of Alcohol Excise Tax, 38 Fed. Reg. 40,675 (August 16, 2018) where CBP and the Department of Treasury amended 19 CFR 24.36. CBP has issued procedures and requirements with their guidance on CBMA in CSMS #18-000609. Importers can now flag the CBMA claim on each entry going forward and file a post summary correction in order to receive a
refund in the tax difference on previous entries. In order for the importer to be eligible to make the CBMA claim, they will be required to provide documentation including the CBMA spreadsheet, CBMA Controlled Group Spreadsheet and the CBMA Assignment Certification.
