Changes to Exclusion Process for Section 232 Tariffs Announced – Update

Section 232 Product Exclusions Now Available from Section Quota Countries 2018-09-17

On August 29, 2018, President Donald Trump issued a proclamation that allows for exclusion requests to be filed for steel and aluminum goods imported from countries that are subject to the Section 232 Quota restrictions. Quotas were put into place for steel goods from South Korea and Brazil, and steel and aluminum goods from Argentina. Products that were granted exclusions would not be subject to the Section 232 tariffs. Quota exclusions will take effect on the date the request was granted.
 
Changes to Exclusion Process and Determinations Announced
 
The Bureau of Industry and Security (BIS) has announced changes to the exclusion process for Section 232 tariffs and quotas on imported steel and aluminum.
 
The new interim final rule allows petitioners to: 
  • Respond to objections posted against the original exclusion request within 7 days
  • Enter new “minimum and maximum dimensions” within the exclusion requests
  • Allow for acceptable ranges in manufacturing as allowed by the tariff provision
The interim rule also provides additional information regarding the BIS criteria for granting or denying exclusion requests, including providing more clarity regarding concepts like “not produced in the U.S. in a sufficient and reasonable available amount” or “satisfactory quality”. A review process for requests that do not receive any objections after the 30-day comment period was also outlined.
