Stainless Steel Sinks – CITT Notice of Expiry Review of Finding
Anti-Dumping Measures on Stainless Steel Sinks from China Will Undergo an Expiry Review 2017-04-20
On April 4, 2017 the CITT gave notice that it will, in fact, initiate an expiry review of its finding made on May 24, 2012 in Inquiry No. NQ-2011-002, concerning the dumping and subsidizing of stainless steel sinks originating in or exported from the People’s Republic of China, is scheduled to expire on May 24, 2017.
Under the Special Imports Measures Act (SIMA), findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.
In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the finding in respect of the subject goods is likely to result in the continuation or resumption of dumping and subsidizing of the subject goods.
If the CBSA determines that the expiry of the finding in respect of any goods is likely to result in the continuation or resumption of dumping and subsidizing, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping and subsidizing is likely to result in injury.
The CBSA will provide notice of its determinations within 150 days after receiving notice of the Tribunal’s decision to initiate an expiry review, that is, no later than September 1, 2017. The Tribunal will issue its order and its statement of reasons no later than February 8, 2018.
