SIMA Update – Gypsum Board from the USA
Request for Panel Review Has Been Submitted to the NAFTA Secretariat to Challenge the Final Determination Made by the CITT in the Case of Certain Gypsum Board from the USA 2017-02-23
On January 19, 2017, Milgram posted an article concerning the final determination and finding of injury made by the CITT in the case of gypsum board imported from the United States for markets in Manitoba, British Columbia, Saskatchewan, Alberta, Yukon and the Northwest Territories.

On February 6, 2017, a Request for Panel Review of the final determination made by the CITT in the instant case was filed by counsel for CGC Inc. and USG Corporation with the Canadian Section of the NAFTA Secretariat, pursuant to Article 1904 of the North American Free Trade Agreement.
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.
